Terms of Use

These Terms of Use (the “Terms”) form a binding agreement between you and Ngoc Quy Nguyen (“we”, “us” or “our”) and govern your access to and use of the Rampart application and any related services, content and features (together, the “App”).

By downloading, installing, accessing or using the App you confirm that you have read and understood these Terms and that you agree to be bound by them. If you do not agree, please do not use the App.

Rampart is provided by Ngoc Quy Nguyen as an informational and organisational tool. The App is made available on an ongoing-development basis and may be changed, extended, limited or withdrawn at any time.

We provide software and information only. We are not a law firm, a financial institution, a payment service, a money transmitter, a claims administrator or a professional adviser, and nothing in the App constitutes legal, financial, tax or investment advice.

The App is not directed to children under 13 years of age. If you are below the age of majority in your jurisdiction, you may use the App only with the permission and supervision of a parent or legal guardian and only where such use is permitted by applicable law and by the rules of the relevant app store.

Subject to these Terms we grant you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the App for your own personal, non-commercial purposes.

You agree not to: copy, reproduce, resell, rent, lease, sublicense, distribute or commercially exploit the App; reverse engineer, decompile, disassemble, translate or create derivative works of the App except to the extent permitted by mandatory law; scrape, harvest, data-mine or bulk-extract content from the App; interfere with, overload, disrupt or attempt to gain unauthorised access to the App or its infrastructure; remove or alter any proprietary notices; or use the App for unlawful, harmful, abusive, deceptive or malicious purposes.

The App may be free to download while certain features may require a paid subscription. Purchases made through the Apple App Store are processed by Apple; purchases made through Google Play are processed by Google. Your purchase is also subject to the terms of the applicable store.

Recurring subscriptions renew automatically for the period you selected unless you cancel them in your store account settings before the renewal date. Deleting the App does not cancel an active subscription. Refund requests are handled by the store through which the purchase was made, in accordance with that store’s policies.

The App may contain links to third-party websites, services or resources. Those are operated independently and under their own terms and privacy practices. We do not control them and are not responsible for their content, availability, security or accuracy. Following such a link is at your own risk.

The App, including its software, design, interface, text, graphics, logos, trademarks and the selection and arrangement of its content, is owned by Ngoc Quy Nguyen or its licensors and is protected by intellectual property laws. No rights are granted to you other than the limited licence described above.

We do not guarantee that the App will operate on every device, network or operating-system version, or that it will be uninterrupted, timely, secure or error-free. The App may be unavailable during maintenance, updates or due to technical failures or third-party service changes.

We aim to keep information useful and current but we do not warrant that any content is complete, accurate, up to date or suitable for any particular purpose. You are responsible for independently verifying information before relying on it or acting on it.

To the maximum extent permitted by applicable law, the App and all content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or quiet enjoyment.

To the maximum extent permitted by applicable law, Ngoc Quy Nguyen and its affiliates, officers, directors, employees, contractors, suppliers and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data, opportunity or use, arising out of or in connection with your use of, or inability to use, the App.

To the extent that liability cannot be excluded, our total aggregate liability for all claims relating to the App is limited to the amount you paid for the App or for the subscription giving rise to the claim during the twelve months preceding the event giving rise to the claim.

You agree to defend, indemnify and hold harmless Ngoc Quy Nguyen and its affiliates, officers, directors, employees, contractors and agents from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to your misuse of the App, your breach of these Terms or your violation of any law or third-party right.

You may stop using the App at any time. We may suspend or terminate your access to the App, in whole or in part, at any time and without notice if we reasonably believe you have breached these Terms or if we discontinue the App. Sections that by their nature should survive termination will continue to apply.

These Terms are governed by the laws applicable at the place of establishment of Ngoc Quy Nguyen, without regard to conflict-of-law rules, and mandatory consumer protections of your country of residence remain unaffected.

Before starting any formal proceedings, you agree to contact us at [email protected] and describe the issue so that we can attempt to resolve it informally. Disputes that cannot be resolved informally may be brought before the competent courts, unless mandatory law provides otherwise.

We may update these Terms from time to time, for example to reflect changes in the App or in applicable law. The updated version will be published on this page with a new “last updated” date. Your continued use of the App after the updated Terms take effect constitutes acceptance of them.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation or sale of assets.
